This Privacy Policy explains how Clinton St, Inc. ("Bites," "we," "us," or "our") collects, uses, discloses, and protects information when you use the Bites mobile application, eatwithbites.com, app.eatwithbites.com, and related services (collectively, the "Service").

1. Information We Collect

Account and contact information. We may collect your email address, phone number, name, authentication details, and account identifiers when you create or access an account.

Profile, nutrition, and health-related information. We may collect your nutrition goal, current and goal weight, height, sex, age or date of birth, activity level, dietary preferences, food likes and dislikes, and related onboarding responses. Some of this information may be considered sensitive personal information under applicable law.

Location information. With permission, the app may collect precise device location to show nearby restaurants. You may also provide a city or other location manually.

Usage, device, and diagnostic information. We may collect screens and features used, search queries, interactions, referral information, app version, device and advertising identifiers, IP address, browser type, operating system, crash data, and similar diagnostics.

Purchases and subscriptions. We collect transaction identifiers, product and price selected, subscription status, renewal and cancellation status, and limited payment-related information. Apple processes in-app purchases, and Stripe processes purchases made through our website. We do not receive or store your complete payment card number.

Content you submit. Menu photos submitted through Scan, prompts and messages sent through Ask AI, support communications, and other content you choose to provide may be processed to deliver those features.

Cookies and attribution data. Our websites may use cookies, pixels, SDKs, click identifiers, and similar technologies to remember your session, measure use, prevent fraud, and, where enabled and permitted, measure advertising performance.

2. How We Use Information

• Provide, personalize, secure, and improve the Service
• Create and authenticate accounts and connect purchases to the correct account
• Generate restaurant, menu, nutrition, and AI-assisted recommendations
• Process subscriptions, payments, renewals, cancellations, and support requests
• Measure product performance, diagnose problems, and prevent abuse or fraud
• Measure advertising campaigns where tracking is enabled and legally permitted
• Comply with law and enforce our Terms of Service

3. When We Disclose Information

We disclose information to vendors that help operate the Service and only as reasonably necessary for their role. These may include:

• Apple for Sign in with Apple and App Store purchases
• Google for sign-in, location services, and AI processing
• Convex for backend infrastructure, authentication, and data storage
• Stripe for web payments, billing, and fraud prevention
• Superwall for mobile paywall and subscription management
• PostHog for product analytics and feature configuration
• Meta and TikTok for advertising measurement where enabled
• Twilio and Resend for account authentication and transactional messages
• Vercel and Cloudflare for website hosting, delivery, security, and analytics

We may also disclose information when required by law, to protect rights and safety, in connection with a corporate transaction, or with your direction or consent.

4. Advertising, Tracking, and Your Choices

The Bites app and websites may integrate Meta and TikTok technologies to measure whether advertising led to actions such as viewing an offer, starting checkout, beginning a trial, subscribing, or purchasing. Depending on your choices and platform rules, those providers may receive device or browser identifiers, click and cookie identifiers, IP address, user agent, event details, and hashed identifiers such as email or our internal user ID. We do not send your nutrition profile, location coordinates, menu photos, or AI prompts to these advertising providers.

On iOS, you can manage tracking permission in Settings. On the web, advertising technologies remain disabled unless configured and may also be subject to an available privacy control or consent choice. We honor legally required opt-out signals, including Global Privacy Control, where applicable. You may also contact us to opt out of the sale or sharing of personal information for cross-context behavioral advertising.

We do not sell personal information for money. Certain advertising disclosures may be considered a "sale," "sharing," or targeted advertising under some privacy laws.

5. Retention and Security

We retain information only as long as reasonably necessary for the purposes described here, including to maintain your account and subscription, meet legal and accounting obligations, resolve disputes, and prevent abuse. Retention varies by data type and context. We use administrative, technical, and organizational safeguards, but no system is completely secure.

6. Your Privacy Rights

Depending on where you live, you may have rights to know, access, correct, delete, or obtain a copy of personal information, restrict or object to certain processing, and opt out of certain advertising disclosures. You may delete your account in the app or contact us. We may need to verify your request. You may use an authorized agent where permitted, and we will not discriminate against you for exercising privacy rights.

7. Children

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided information, contact us so we can take appropriate action.

8. International Processing

Information may be processed in the United States and other countries where we or our providers operate. Those countries may have different data protection laws.

9. Changes to This Policy

We may update this Policy. We will post the revised version and update the effective date, and will provide additional notice when required by law.
